JOHN HARLO TINGEY

Sentencing is scheduled for March 9, 2015.

John Harlo Tingey (age 34), a resident of American Fork, was recklessly operating his black 1996 Toyota Camry in the parking lot of the Art Dye Ballpark, located at 1000 North 550 East in American Fork, on June 3, 2014 between the hours of 8:00 and 9:00 p.m. A concerned citizen reported that for approximately 45 minutes, Mr. Tingey had been driving in circles, weaving in and out of parked vehicles, and intermittently would stop the car, yell at the car, and hit the car. Several children were present at the park at the time of the incident. When officers from the American Fork Police Department arrived, they immediately noticed signs of intoxication. Mr. Tingey failed field sobriety tests and officers discovered he was in possession of the drug "Soma" (a.k.a Carisoprodol, a schedule IV controlled substance) and a large bottle of whiskey which appeared to be two- thirds empty. Mr. Tingey was arrested and booked into the Utah County Jail. An hour after initial contact by police, John Tingey's breath test was 0.071. Mr. Tingey has multiple prior felony convictions involving DUI's and Possession of a Controlled Substance from 2002, 2005, 2006, 2007, and April of 2014.

On January 29th and 30th, 2015, John Harlo Tingey stood trial for the following four charges: (1) Third Degree Felony for Driving Under the Influence of Alcohol; (2) Third Degree Felony for Possession of a Controlled Substance in a Drug Free Zone with a Prior Conviction; (3) Class C Misdemeanor for an Open Container in Vehicle; and (4) Class B Misdemeanor for operating a vehicle as an Alcohol Restricted Driver. Despite Mr. Tingey's claim that on the evening of June 3, 2014, he was not operating his vehicle but was taking care of personal hygiene, a jury of eight persons found John Harlo Tingey guilty on all four counts. Mr. Tingey will be sentenced on March 9, 2015 in the 4th District Court.
