JOSHUA STUART ERCANBRACK

On Friday, August 15, 2014, Mr. Ercanbrack was found guilty of Aggravated Assault, a 3rd Degree Felony, and Assault, a Class A Misdemeanor. Sentencing has been scheduled for September 23, 2014, at which time Mr. Ercanbrack may be sentenced to an indeterminate term of 0-5 years in the Utah State Prison.

On New Year's Day, 2014, in Orem, Utah, 32 year old Joshua Stuart Ercanbrack was arrested and charged with Aggravated Assault (3rd Degree Felony), Domestic Violence in the Presence of a Child (3rd Degree Felony), and Assault (Class A Misdemeanor) after attacking his mother (age 54) & step-father (age 55) in the presence of Mr. Ercanbrack's child. The assault began when Mr. Ercanbrack "white-washed" his mother's face in the snow. The violence continued inside the home as Mr. Ercanbrack hit and kicked his mother in the head, then choked her until she lost consciousness. When the female victim's husband intervened to protect her, Mr. Ercanbrack turned the brutal attack on his step-father. Orem police officers arrived just moments after Mr. Ercanbrack fled the scene. Both victims were transported to the hospital and a medical examination revealed that the male victim sustained multiple right chest rib fractures, a brain bleed on the left side of his head, and the loss of a tooth from being kicked and stomped on repeatedly. At the time of this violent incident, Mr. Ercanbrack was on probation for a recent aggravated assault conviction after beating a victim with a metal baton and then attempting to return with an assault rifle and pistol. As part of Mr. Ercanbrack's probation requirements, he was ordered to attend anger management classes.

On Friday, August 15, 2014, after a two-day jury trial, Joshua Stuart Ercanbrack was found guilty of Aggravated Assault, a 3rd Degree Felony, and Assault, a Class A Misdemeanor. Sentencing has been scheduled for September 23, 2014, by the Honorable Christine Johnson (4th District Judge) at which time Mr. Ercanbrack may be sentenced to an indeterminate term of 0-5 years in the Utah State Prison.
